This website is operated by Mischief Games LLC. Throughout the site, the terms “we”, “us” and “our” refer to Mischief Games. Mischief Games offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

All intellectual Property Rights, copyright or trademark used in the website and its content, this to include, without limitation, all design, text, graphics, software, source code and the like connected with the website and the products supplied are owned by us, or under license to us.

We confirm that We will adhere to our terms in respect of your data as per our Privacy Policy however we can not give any guarantee as to the confidentiality of the information submitted over the Internet. If such information is disclosed it is entirely Your responsibility and You acknowledge and accept that We have no responsibility for that disclosure.

The use of this website and the documents to which it refers, including these terms and conditions is to be considered the entire agreement. Any failure to enforce the terms of this agreement by us cannot be construed as a waiver of any of the terms of this agreement either now or in the future.

Mischief Games LLC is not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on the site. You agree that it is your responsibility to monitor changes to the site.

 

SECTION 4 - INDEMNIFICATION

You agree to defend, indemnify and hold Mischief Games LLC harmless from and against any and all claims, damages, costs and expenses, including attorney's fees, arising from and related to your use of the Site.

As a convenience to users, this Site may link to other sites owned and operated by third parties and not maintained by Mischief Games LLC. However, even if such third parties are affiliated with Mischief Games LLC, Mischief Games LLC has no control over these linked sites, all of which have separate privacy and data collection practices and legal policies independent of Mischief Games LLC. Mischief Games LLC is not responsible for the contents of any linked sites and does not make any representations regarding the content or accuracy of material on such sites. Viewing such third-party sites is entirely at your own risk. 

 

SECTION 6 -  RETURNS AND EXCHANGES

Here at Mischief Games, we want all customers to enjoy our games as much as we do. While we are unable to offer returns or exchanges on our digital products, we can offer a full refund within 7 days of the original purchase date. If 7 days have passed and you are still not satisfied, please reach out to us at hello@mischiefgames.co and we will work with you to make it right. We do not offer returns or exchanges for e-gift cards. 

 

SECTION 7 - ORDER CANCELLATION

We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to:

•   Goods availability
•   Errors in the description or prices for Goods
•   Errors in Your Order

We reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected. 

 

SECTION 8 - MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 9 -  VIOLATIONS OF COPYRIGHT/PLAGIARISM

You hereby agree not to post any portion of our game content (including but not limited to text pulled directly from the game materials, graphics that might include spoilers, or photos of the victim and/or murderer in the game) online or otherwise. If you breach this agreement, the Company may pursue legal action against you for the calculated loss of revenue of the Game including the loss of current Users requesting exchanges, loss of future sales at a 15% increase over the existing calendar year for 10 years, and billable hours of the author to create revisions to reinstate the value of the Game (which may be up to 80 hours of billable time at $100.00 per hour), editor's fees for the revised Game (which may be up to 10 hours of billable time at $100.00 per hour), in addition to all associated legal fees in pursuing the settlement. 

All images and articles on this site will be credited to the original author if it is not ourselves, (which will also be noted). No copying of any sort of any of the images or content is permitted.  The images and content are fully protected under copyright laws and may have proprietary rights attached to them. Such proprietary rights may be but not exclusively Intellectual Property Rights.

Should you breach in any way these rights by reproducing, copying or in any other such way, We will prosecute to the fullest extent of the law on behalf of ourselves and Our suppliers, partners and others.

Your access and use of this website, the content, products and services offered on the site, including any products and their use, that You may make use of are done so strictly in accordance with these Terms of Service.

Posting our game or any portion of our published game on any online site (i.e., social media, blogs, etc.) is a violation of copyright, and damages will be assessed based upon the loss of sales for the time period the game/portion of the game was online. Even if you delete your post, screenshots are always available from a past date. Deleting a post will not erase the violation. An example of this would be posting a spoiler, such as a picture that indicates the victim/killer or text from the Character Booklets. This prevents future hosts (Mischief Games Buyers) from hosting the game, as spoilers are available online for their players. This creates a documented, calculated loss of business. You will be asked to pay for the calculated loss of sales upon discovery of the violation. It is the Buyer/User/Licensee's responsibility to notify their players of the game of this policy.  

Removing our copyright line and/or reproducing our materials, and/or claiming you are the author of the game in any manner is a violation of copyright and will be considered an act of plagiarism. These games are non-editable. Re-typing the material and presenting it as your own is an act of plagiarism.

SECTION 10 - NO RESALE OR COMMERCIAL USE ALLOWED

While using this website, including its content, products, and services, whether offered for use or purchased, you agree to use the provided content and resources solely for your personal and private use. Any usage for commercial purposes or the benefit of third parties other than your own private use is strictly prohibited.

You will not use this website and the products and services offered including its contents and the resources for any unlawful or prohibited purpose.

You will not, and you expressly agree to this term, resell the product, to any other person, or organization. The purchase is strictly for your own personal and private use.  

You will not in respect of the content, the services offered and the resources available on the site reverse engineer, transfer or participate in the transfer, modify, publish or copy, or in any other such way exploit commercially the content or resources other than permitted by these terms.

SECTION 11 - SEVERABILITY AND WAIVER

11.1 Severability 

If any provision of these Terms is determined to be unenforceable or invalid, that provision shall be modified and interpreted to achieve the intent of the provision to the fullest extent permitted by applicable law. The remaining provisions of these Terms shall remain in full force and effect.

11.2 Waiver  

Except as expressly provided in these Terms, the failure to exercise a right or to enforce an obligation under these Terms shall not prevent a party from exercising that right or enforcing that obligation at any later time. Furthermore, the waiver of a breach of these Terms shall not be deemed a waiver of any subsequent breach.
